¿Administración desleal mediante la creación del riesgo de sanciones para el patrimonio administrado?
Un análisis dogmático a la luz del art. 252 del Proyecto de Reforma del Código Penal de 4 de Octubre de 2013

El presente trabajo examina si, en el marco del nuevo delito de administración desleal recogido en el Proyecto de reforma del Código Penal (art. 252 PCP), resulta posible que aquellas conductas llevadas a cabo por el administrador constitutivas de un ilícito – sea éste penal, administrativo o civil – del que se derive un menoscabo para el patrimonio administrado sean a su vez constitutivas de un delito de administración desleal. Tras exponer el problema en toda su extensión y analizar las soluciones formuladas en la doctrina y jurisprudencia alemanas, se expone una propuesta de solución. Para ello, se analizan los tres pilares esenciales de la dogmática del nuevo delito de administración desleal: el alcance de la posición de garantía del administrador, el concepto de perjuicio patrimonial y los criterios de imputación del perjuicio a la infracción del deber de velar por los intereses patrimoniales ajenos.

Embezzlement and abuse of trust through the creation of a risk of sanction affecting third-party economic interests? An Analysis in the Light of Section 252 of the Draft Amendment to the Penal Code of 4.10.2013.

This paper examines if, under the new offense of embezzlement and abuse of trust as set out in the draft amendment of the Penal Code (Section 252 PCP), it is possible that those conducts engaged in by the manager which constitute a statutory violation––be it criminal, administrative or civil––, and
from which a detriment to the assets under management is derived, can in turn constitute an offense of embezzlement and abuse of trust. After describing the problem in its full scope, and after going through the solutions proposed in German literature, a solution proposal is put forward. In order to
do so, the three essential theoretic pillars of the new embezzlement and abuse of trust offense are analysed: the scope of the administrator’s guarantor position, the concept of damage and the criteria for the attribution of the damage to the breach of the duty to safeguard third-party economic
interests.
