Custodia compartida: Una alternativa exigida por la nueva realidad social

En el año 2005 se reformó el Código civil español introduciéndose en él la figura de la custodia compartida, si bien se trató de una reforma tanto incompleta como excesivamente cauta. Incompleta porque no contempla la ruptura de las parejas no matrimoniales, y excesivamente cauta pues, a contrario de lo que ocurría con anterioridad, tras la reforma se veta al juez poder decidir la custodia compartida de oficio. Por otra parte, este tipo de custodia ha quedado como una figura subsidiaria obstaculizada por unos requisitos que no se acomodan ni a los nuevos tiempos ni a nuestra Constitución. En este trabajo se ofrece un estudio pormenorizado de esta modalidad de custodia, así como una propuesta para paliar ciertas deficiencias de la vigente normativa en tanto que ésta no sea reformada, pues el empuje de la realidad social hace inevitable dicha reforma.

Joint custody: An Alternative Required by the New Social Reality

The Spanish Civil Code was reformed in 2005 in order to introduce a new regulation of joint custody. This reform was both incomplete and overly cautious. It was incomplete because it did not regulate the breakdown of non-marital partners, and overly cautious because, contrary to the prior procedures, after the reform Judges were not allowed to decide joint custody ex officio. Moreover, this type of custody has been relegated to a subsidiary figure by requirements that fit neither our modern times nor our Constitution. This paper provides a detailed study of this type of custody, and a proposal to palliate certain maladjustment to the regulations in force. Regulations that, due to the trajectory of the social reality, will inevitably be in need of reform soon.
