Argumentos a favor de una teoría jurídica del delito bipartita más allá (y a pesar de) la teoría de los elementos negativos del tipo

La cuestión de si la teoría jurídica del delito debe estructurarse en dos o tres grandes categorías se ha venido vinculando con la de la viabilidad de la Teoría de los elementos negativos del tipo (TENT). En este artículo, sin embargo, se argumenta que tal asimilación es conceptualmente errónea (ya que la estructuración bipartita puede defenderse sin necesidad de aceptar la TENT) e históricamente problemática (ya que la historia de la TENT es un excelente ejemplo de cómo no debe defenderse o criticarse una teoría).

Should criminal law theory be structured in a bipartite or in a tripartite fashion? In Civil law countries the question has been strongly joined to that of the viability of the Theory of the negative elements of the crime definition (Lehre von den negativen Tatbestandsmerkmalen). In this article it will be argued that such a view is both conceptually wrong (because the bipartite structure can be defended without recourse to the Theory of the negative elements of the crime definition) and historically problematic (given the fact that the historical evolution of said theory offers a great example of how one should not proceed when defending or criticizing a theory).
