Delito contra la libertad sexual y muerte dolosa «subsiguiente» agravada

En el CP español, la muerte dolosa por el hecho de perpetrarse subsiguientemente a un delito contra la libertad sexual, determina una extraordinaria agravación, que en el asesinato lleva a la prisión permanente revisable. Tan notable es esta agravación, que ha de cuestionarse en profundidad su fundamentación, sin perder de vista la agravación de la muerte para ocultar otro delito (que convierte el homicidio en asesinato), en cierta medida coincidente con aquella. Realizado el intento de hallarla, ante la ausencia de una fundamentación convincente que permita comprender por qué ha de agravarse la muerte subsiguiente por razones distintas al mero propósito de eludir la responsabilidad penal por el delito sexual previo, se opta por la aplicación subsidiaria de la agravante específica, solo en defecto de la aplicación de la de autoencubrimiento. Ello en sentido divergente con la jurisprudencia que va abriéndose camino. Por otra parte, se trata de fundamentar por qué de los delitos sexuales previos deben quedar excluidos los delitos que atentan contra la indemnidad sexual, así como poner de manifiesto varias presuposiciones en que acríticamente incurre la jurisprudencia.

Crimes against sexual freedom and aggravated "subsequent" intentional deaths

In the Spanish Penal Code, the intentional death due to the fact of being perpetrated subsequent to a crime against sexual freedom, determines an extraordinary aggravation, which in the case of murder leads to reviewable life imprisonment. This aggravation is so remarkable that it requires an in-depth consideration of its justification, without losing sight of the aggravation of death to hide another crime (which turns homicide into murder), to a certain extent coinciding with that one. Once the attempt has been made to find it, in the absence of a convincing justification that enables us to understand why the subsequent death should be aggravated for reasons other than the mere purpose of avoiding criminal responsibility for the previous sexual crime, it is chosen the principle of subsidiary application of the specific aggravating factor only in the absence of the application of the self-concealment. This in a divergent sense with the jurisprudence that is being established. On the other hand, I try to substantiate why crimes against sexual indemnity should be excluded from previous sexual crimes, as well as to highlight several presuppositions that jurisprudence uncritically incurs.
