Este trabajo examina cómo puede entenderse la rehabilitación del autor dentro de la Justicia Restaurativa. Considerando que conceptos como la reinserción de quien ha delinquido se han planteado, fundamentalmente, dentro del Derecho penal, teniendo como centro de análisis los fines de la pena, cabe preguntarse si las tesis preventivo especiales pueden aplicarse también respecto de la Justicia Restaurativa, considerando que ésta descansa sobre otros pilares distintos a la pena. Asimismo, se analiza si las prácticas restaurativas pueden tener impacto en la reducción de la reincidencia y de qué forma pueden entenderse hoy nociones como el desistimiento delictivo, en cuanto a impulsar cambios en la conducta del ofensor hacia la evitación en la comisión de nuevos delitos.

Desistance and rehabilitation of the offender in Restorative Justice. Some considerations.

This paper examines how the rehabilitation of the offender can be understood within Restorative Justice. Considering that concepts such as the reintegration of those who have committed a crime have been raised, fundamentally, within Criminal Law, having as the center of analysis the purposes of punishment, it is worth asking whether the special preventive thesis can also be applied to Restorative Justice, considering that this rests on other pillars other than punishment. Likewise, it is analyzed whether restorative practices can have an impact on the reduction of recidivism and in what way notions such as criminal desistance can be understood today, in terms of promoting changes in the offender’s behavior towards the avoidance of committing new crimes.
