El artículo 5.1.b) del Reglamento Bruselas I: examen crítico de la jurisprudencia reciente del Tribunal de Justicia

El Tribunal de Justicia ha dictado hasta ahora seis sentencias en relación con el artículo 5.1.b) del Reglamento (CE) 44/2001 del Consejo, de 22 de diciembre de 2000, relativo a la competencia judicial, el reconocimiento y la ejecución de resoluciones judiciales en materia civil y mercantil (Reglamento Bruselas I). Estas resoluciones han incidido en la delimitación del ámbito de aplicación material de esta disposición en el tratamiento de los supuestos de pluralidad de lugares de entrega de las mercaderías o de prestación de los servicios, y en el método de identificación de dichos lugares de cumplimiento. Al hilo del análisis de estas sentencias el autor examina críticamente la labor del Tribunal de Luxemburgo, especialmente en la medida en que ha ido más allá de su función interpretativa. En efecto, se deduce de estas sentencias una voluntad de reconducir al ámbito del artículo 5.1.b) supuestos que en puridad deberían haberse subsumido en el artículo 5.1.a). Para ello, el Tribunal se ha visto obligado a crear normas que van más allá de la dicción de la disposición interpretada y, lo que es peor, que atentan contra la previsibilidad y la seguridad jurídica que el Reglamento pretende garantizar.

Article 5.1.b) of the Brussels I Regulation: Critical Assessment of the Recent Case Law of the Court of Justice

To date the Court of Justice has given six judgments in relation to Article 5.1.b) of the Council Regulation (EC) 44/2001, of 22 December 2000, on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I Regulation). These decisions have dealt with the delimitation of the material scope of application of this provision, with the solution of cases involving several places of delivery of goods or of provision of services, and with the method by means of which the place of performance should be identified. While analysing these judgments, the author critically assesses the role of the Court of Justice, especially insofar as it has gone beyond its interpretive function. Indeed, these cases show a willingness to bring within the scope of Article 5.1.b) cases that should have actually been examined under Article 5.1.a). To that end, the Court was forced to create rules that go well beyond the wording of the interpreted provision, and what is worse, that run against the predictability and legal certainty that the Regulation intends to guarantee.
