El daño moral de autor y la llamada regalía hipotética. Reflexiones al hilo del caso Liffers.

El asunto Liffers, recientemente resuelto por el Tribunal de Justicia de la Unión Europea, que ha considerado que la indemnización por daño moral, una vez causado, es independiente del criterio de cálculo utilizado para cuantificar el daño patrimonial, nos ha permitido analizar la aplicación a los derechos de autor, del régimen indemnizatorio incluido en la Directiva 2004/48 que recoge el artículo 140 del Texto Refundido de la Ley de Propiedad Intelectual. Con el fin de comprobar si logra los objetivos de compensación y disuasión previstos, hemos estudiado el contexto normativo, europeo y español, la doctrina, y la jurisprudencia, mayor y menor, de los últimos veinte años, sobre el daño moral de autor y la regalía hipotética.
Tras el trabajo realizado, hemos concluido que la interpretación realizada en la sentencia Liffers puede mejorar la compensación que perciben los titulares de los derechos infringidos, si nuestros tribunales, una vez probada la infracción, moderan el despliegue probatorio en torno a la cuantificación de la indemnización si el perjudicado ha optado por la licencia o regalía hipotética. Sin embargo, la capacidad disuasoria de la norma seguirá siendo limitada, mientras no se permita acumular a las cantidades obtenidas mediante regalía hipotética y por daños morales por el titular del derecho infringido los beneficios del infractor.

Moral damages and hypothetical royalties. Reflections on the Liffers case

The Court of Justice of the European Union has recently settled the Liffers case and has considered in its legal ruling that compensation for moral damage, once done, is independent of the calculation criteria used to quantify the financial damage. This ruling has allowed us to analyze the application of copyright, the compensation scheme included in the Directive 2004/48 set out in Article 140 of the Spanish Consolidated Text of the Intellectual Property Law. In order to check if it achieves the objectives of compensation and deterrence provided, we have studied the European and Spanish legal context, doctrine, and jurisprudence, major and minor, in the last twenty years, about moral damage copyright and hypothetical royalties.

Finally, we have concluded that the interpretation given in the Liffers judgement can improve the compensation paid to the right holders, if our courts (once proven the infringement) moderated the probative deployment around the quantification of compensation if the injured party has opted for the hypothetical royalty. However, the deterrent capability of the current legislation will remain limited, until it will not allow the accumulation by the right holder of the amounts obtained by hypothetical royalties and the moral damages inflicted to the infringer’s profits.
