El derecho de los testigos parientes a no declarar en el proceso penal

Ante el aumento de supuestos en los que los familiares son víctimas del hecho delictivo sobre el que no tienen obligación de declarar, cada vez con más frecuencia se está poniendo en tela de juicio el alcance que ha de reconocerse al privilegio que el art. 416 LECrim reconoce a favor de los parientes del acusado. En este artículo se propone replantear el tema desde una perspectiva distinta, que parte del análisis del fundamento de este privilegio para ofrecer desde ahí una respuesta unívoca a todas las otras cuestiones planteadas: su alcance objetivo y subjetivo, el procedimiento que ha de seguirse y su valor probatorio.

The privilege not to testify against relatives in criminal procedure

With the increasing number of cases in which family members are victims of the crime about which they have no obligation to declare, with increasing frequency the extent of the privilege in favor of the relatives of the accused, recognized in article 416 of the Spanish Criminal Procedural Law (LECrim), is questioned. In this paper, this issue is reconsidered from a different perspective, taking as a starting point the analysis of the rationale of this privilege in order to offer a straight answer to all other questions: its objective and subjective scope, the procedure to be followed and its probative value
