El primer fallo de la Corte Penal Internacional (Prosecutor v. Lubanga): un análisis integral de las cuestiones jurídicas

El 14 de marzo de 2012, la Sala de Primera Instancia I (en adelante, la Sala) de la Corte Penal Internacional (en adelante, CPI o la Corte) dictó el muy ansiado primer fallo de la Corte (en adelante, el fallo); el 10 de julio Lubanga fue condenado a 14 años de prisión. Este comentario se enfoca exclusivamente en las cuestiones jurídicas que fueron abordadas en el fallo pero pretende hacerlo de manera integral. Los siguientes cinco temas, junto con sus respectivas cuestiones jurídicas, serán abordados críticamente: la definición y participación de las víctimas; la presentación y valoración de las pruebas; la índole del conflicto armado; el crimen de guerra de reclutamiento y utilización de niños menores de 15 años (artículo 8(2)(e)(vii) del Estatuto de la CPI); y por último, si bien no menos importante, la coautoría como modo de responsabilidad, incluyendo el elemento subjetivo (artículos 25, 30). A pesar de que este artículo sigue el orden del fallo para la conveniencia del lector y para mejor capturar la secuencia argumentativa del mismo, la extensión y profundidad del análisis que se haga de cada uno de los temas, así como de sus respectivas cuestiones jurídicas, dependerán de su importancia para la jurisprudencia futura de la Corte al igual que del convencimiento que genere el tratamiento que la Sala misma haga del asunto. Este artículo concluye con algunas observaciones generales sobre aspectos relativos a la redacción, la presentación y sobre la citación de referencias.

The First Judgment of the International Criminal Court (Prosecutor v. Lubanga): A comprehensive analysis of the legal issues.

On 14 March Trial Chamber I (hereinafter ‘the Chamber’) of the International Criminal Court (‘ICC’ or ‘the Court’) delivered the long awaited first judgment of the Court (‘the judgment’). On July 10th Lubanga was sentenced to 14 years imprisonment. This comment focuses exclusively on the legal issues dealt with in the judgment but pretends to do this comprehensively. It critically analyses the following five subject matters with the respective legal issues: definition and participation of victims; presentation and evaluation of evidence; nature of the armed conflict; war crime of recruitment and use of children under fifteen years (Article 8 (2)(e)(vii) ICC Statute); and, last but not least, co-perpetration as the relevant mode of responsibility, including the mental element (articles 25, 30). While this pa- per follows the order of the judgment for the reader’s convenience and to better represent the judgment’s argumentative sequence, the length and depth of the inquiry into each subject matter and the respective issues depend on their importance for the future case law of the Court and the persuasiveness of the Chamber’s own treatment of the issue. The paper concludes with some general remarks on aspects of drafting, presentation and referencing.
