El rechazo del tratamiento médico por los menores de edad en grave riesgo

El rechazo del tratamiento por parte de un menor en grave riesgo vital nos sitúa ante un complejo dilema ético. Los menores de edad tienen derecho a la libertad religiosa y a la integridad física y moral; también, cuando son maduros, a otorgar por sí mismos el consentimiento para el tratamiento y, por tanto, a denegarlo. No obstante, no existe acuerdo en la doctrina sobre el alcance de estos derechos del menor, en especial cuando su vida o su salud están en peligro. El deber de proteger su interés y el valor fundamental de la vida humana podrían limitar su ejercicio y justificar la imposición del tratamiento incluso cuando el menor es maduro. Tanto quienes se inclinan por respetar la autonomía del menor como quienes proclaman el deber de proteger su vida cuentan con argumentos éticos y jurídicos a su favor, pero ni la vida ni la autonomía individual poseen un valor absoluto que justifique que una de ellas deba prevalecer necesariamente en cualquier circunstancia. El debate entre estas dos posiciones solo avanzará si ambas partes renuncian a apoyarse en concepciones morales sustantivas acerca del bien humano y se comprometen a defender el interés del menor desde una perspectiva imparcial y moralmente neutral.

Minors’ refusal of life-saving therapies

The refusal of medical treatment by a minor in a life-threatening situation presents us with a difficult ethical dilemma. Minors have freedom of religion and also the right to physical and moral integrity; when the minor becomes “mature”, he/she can give their consent for medical treatment but they also can refuse it altogether. However, there is no agreement in the literature about the scope of such rights of minors, especially when their lives are at risk. Our duty to protect their interests and the fundamental value of human life may put a limit on their rights and may justify the imposition of medical treatment, even if the minor is considered mature. Both those who support a minor’s autonomy, as well as those who justify the duty to protect his/her life rely on ethical and legal arguments respectively, but neither life nor the individual wish possesses an absolute value that justifies that one must necessarily prevail in all circumstances. The debate between these two positions proceeds only when both sides waive their views based on fundamental moral conceptions of the good of the human being, and commit to defending the minor’s interest from an impartial and morally neutral perspective.
