El vínculo de ciudadanía como límite a la aplicación extraterritorial del Derecho penal: una revisión crítica

La creciente permeabilidad de las fronteras estatales y la existencia de un mayor número de tratados internacionales está llevando a muchos legisladores nacionales a ampliar el ámbito de aplicación de la ley penal en el espacio, sometiendo cada vez más hechos ocurridos en el extranjero a la jurisdicción nacional. Frente a este fenómeno, la teoría dominante, que concibe al Derecho penal como un instrumento para la protección de bienes jurídicos, no ofrece un freno normativo adecuado. Las teorías del “Derecho penal del ciudadano”, al legitimar la pena a partir del vínculo (político) previo entre el Estado y el castigado, parecen en principio una alternativa promisoria. Sin embargo, como habrá de mostrarse en este trabajo -tomando como referencia el Derecho alemán y chileno-, un análisis más profundo de algunos de los principales modelos basados en la ciudadanía que no tienen raigambre deliberativa (en concreto, los de SILVA SÁNCHEZ, DUFF y PAWLIK) revela que, a menos que dichos planteamientos se sometan a sustanciales ajustes, estos no ofrecen una opción mejor que la teoría de los bienes jurídicos a fin de contener el poder sancionador del Estado en el espacio.

The bond of citizenship as limit to extraterritorial jurisdiction: a critical review

The growing permeability of state borders plus the existence of a greater number of international treaties will foreseeably put pressure on national legislators to broaden the scope of the application of national criminal law to extraterritorial offenses. The prevailing theory, which understands criminal law as an instrument for the protection of legal goods/interests (Rechtsgüter), does not offer an adequate normative constraint to this ongoing expansion. In contrast, those theories that seek to assert the legitimacy of punishment mainly in the previous (political) bond between the State and the alleged offender (which can be grouped under the label «citizen criminal law» theories), seem in principle a promising alternative. However, I argue that a deeper analysis of some of the main citizenship-based models that do not have Habermasian roots (specifically those of SILVA SÁNCHEZ, DUFF and PAWLIK) reveals that, unless such approaches are subjected to substantial adjustments, they are not a better option than the dominant theory in order to prevent an excessive expansion of the extraterritorial application of the national criminal law. I approach this issue from the perspective of the German and Chilean legal systems.
