En los límites de la inducción

El trabajo analiza la figura participativa de la inducción, principalmente desde las nuevas perspectivas reinantes en la dogmática de la autoría y participación, así como desde los postulados de la imputación objetiva. En primer lugar, pues, si la inducción debe merecer la misma pena que la autoría. Para este análisis, son sometidas a debate las nuevas concepciones sobre la autoría en general, y sobre la intervención delictiva en organizaciones jerarquizadas, en particular, que últimamente vienen siendo sostenidas por parte de la doctrina y de la jurisprudencia. Este análisis, además de la perspectiva de la imputación objetiva, debe ser trazado desde la comparación de la inducción con otras figuras de intervención, como la autoría mediata, la cooperación necesaria o la complicidad psíquica. También son tratadas cuestiones muy específicas de la tipicidad de la inducción, como la homogeneidad que debe existir entre lo inducido y lo ejecutado por el autor, así como la figura del omnimodo facturus, y las subcategorías de las denominadas transinducción, infrainducción y sobreinducción. Un último epígrafe expone las relaciones de la inducción y la comisión por omisión. En definitiva, el trabajo trata de revisar los aspectos más problemáticos de la figura de la inducción, a la luz de las nuevas corrientes en las categorías dogmáticas con las que guarda concomitancia, a los efectos de lograr una unificación de esta figura participativa con el resto de las categorías generales de la teoría jurídica del delito. Un amplio resumen de conclusiones que sometemos a debate científico se encuentra al final del trabajo; allí nos remitimos.

Patrolling the borders of incitement.

The paper studies the figure of incitement, from the nowadays prevailing perspectives in the perpetration and participation dogmatic, as well as from the postulates of the objective imputation. In the first place, it is to be ascertained whether incitement deserves the same punishment as direct perpetration. To this aim the new conceptions lately holded by academics and case law about perpetration, in general, and about criminal intervention through hierarchical organizations, in particular, are brought up for discussion. This analysis, in addition to the perspective of the objective imputation, has to be conducted through the comparison of incitement with other intervention figures, such as the indirect perpetration, the aiding or abetting or the psychological complicity. The paper also deals with very specific questions of the elements of incitement, like the homogenity that has to exist between what is incited and what is executed by the direct perpetrator, the figure of the omnimodo facturus and the subcategories of the so called transincitement, underincitement and overincitement. A last epigraph explains the relations between incitement and inauthentic omissions (also known as commission by omission). To sum up, the paper tries to revise the more problematic aspects of the incitement figure in the light of the new trends in the dogmatic categories with which it is concomitant, in order to reach the unification of this participation figure with the remaining general categories of the legal theory of crime.
