Entre lo político y lo académico: un Common Frame of Reference de derecho privado europeo

Desde que en 2003 («Action Plan») la Comisión Europa evocase la imagen de un Common Frame of Reference (CFR) como instrumento para la mejora de la calidad del acervo comunitario en el ámbito del derecho de contratos gracias a una terminología común y compartida por los Estados miembros, se ha ido dando forma a esta idea en un proceso vertiginoso hacia la consecución de un texto definitivo. En el momento actual nos encontramos en la fase final del proceso al haberse elaborado por un grupo de académicos («Study Group» y «Acquis Group») un denominado Draft Common Frame of Reference (DCFR, 2008), que pretende convertirse en la traducción real de la idea originaria. El proceso y los trabajos han sido intensos y complicados, y muchos son los grupos, instituciones y organizaciones que en él se han involucrado. Las ideas y opiniones no siempre han sido claras y lineales, sobre todo porque las declaraciones de la Comisión frecuentemente se han movido en un halo de ambigüedad, y al mismo tiempo, han existido importantes fricciones entre los implicados. En este trabajo se ponen de relieve estas cuestiones y se evidencia la realidad de que la propuesta académica de un CFR ha sobrepasado con creces el «mandato» inicial. Hay una brecha significativa entre un «CFR político» y otro «académico». Queda por ver qué hará finalmente la comisión: puede aceptarlo todo, rechazarlo por completo, sugerir modificaciones o quedarse con algunas partes.

Between Politics and Academy: A Common Frame of Reference of European Private Law

After the European Commission –in 2003- evoked the image of a Common Frame of Reference (CFR) as an instrument to improve the quality of the common heritage in the field of contracts, and with the help of a more common terminology shared by the Member States, the idea has been developed through a vertiginous process, towards the achievement of a definitive text. At the present moment the final phase of the process is taking place and has been achieved by a group of academics (“Study Group” and “Acquis Group”) the so- called Draft Common Frame of Reference (DCFR, 2008), which aims at becoming the real translation of the original idea. The process and the corresponding work have been intense and complex, and many groups, institutions and organizations have taken part in it. Ideas and opinions have not always been clear and linear, above all, because the Commission’s declarations have often roamed in the halo of ambiguity and at the same time the participants have lived strong frictions between them. This work tries to highlight all these issues and the reality that the academic proposal of a CFR has exceeded the initial “order” abundantly. There is a wide gap between a “political CFR” and an “academic” one. We are still waiting for the Commission’s next step: it might accept it totally, refuse it totally, suggest changes or keep some of its parts.
