Estructuras analíticas del principio de legalidad

El artículo acerca un estudio de las estructuras fundamentales del principio de legalidad a partir de distinguir las incumbencias de los poderes constituidos en las tareas de crear, interpretar e integrar el Derecho penal y de identificar las bases del sistema normativo. Desde esta óptica, el artículo presupone identificar como principal cometido del principio de legalidad la delimitación de las competencias de los poderes constituidos y alejarse de (sin rechazarla completamente) la visión clásica que reduce la función de legalidad a la orientación de conductas del ciudadano. Sobre esta base se propone hacer un diagnóstico de los principales problemas de este principio constitucional, pero también acercar soluciones, sobre la base de las herramientas conceptuales aportadas desde la filosofía analítica y en especial desde las nociones básicas de los sistemas normativos.

Analytical Structures of Legality

This paper analyzes the fundamental structure of the legality principle from the point of view of the distinction
between the powers of each branch of Government in the creation, interpretation and integration of the criminal
law, as well as in the identification of the bases of this normative system. The paper assumes that the most
important task for the principle of legality is the delimitation of the powers of each branch of Government within
the criminal law domain, thus setting itself apart from the classical approach and its focus on the guidance of the
citizenry’s conduct. With the help of analytical philosophy, especially the analytical theory of normative systems,
the most difficult problems surrounding the principle of legality will be diagnosed and resolved.
