¿Existen las Obliegenheiten en el Derecho penal?

El concepto de Obliegenheit es conocido desde hace tiempo por la ciencia jurídico-penal en el contexto de la provocación de la falta de responsabilidad penal. Allí la lesión de Obliegenheiten sirve como criterio normativo para excluir el llamado a una eximente y a partir de allí se restablece la imputación ordinaria. Sin embargo, en los últimos años se ha expandido notablemente su uso a muy diversos ámbitos, tales como la imputación objetiva y la fundamentación de las medidas de seguridad para imputables peligrosos. En todos estos casos las Obliegenheiten aparecen caracterizadas según la “teoría del presupuesto”, dominante en el Derecho privado. Sin embargo, existen muchas razones para entender que la dogmática jurídico-penal ha hecho un mal uso del concepto.

Obliegenheiten in Criminal Law?

The concept of “Obliegenheit” or “underlying obligation” has long been known in European criminal law theory. Traditionally, the concept was studied in relation with the causation of one’s own defense: the violation of Obliegenheiten is understood as a normative reason to exclude the defense and to re-establish the imputation. In the last years, however, the concept has also been used to address other situations, such as objective imputation of results and the foundations of civil commitment. In those cases Obliegenheiten are purportedly characterized in criminal law in the same way that Obliegenheiten are considered in private law theory. However, as this article shows, there is reason to conclude that this import from private law has not been adequately done.
