Heteropuesta en peligro consentida en conductas imprudentes

Con ocasión de su contribución al libro-homenaje a Ingeborg Puppe, el autor hace suya la postura de la homenajeada en relación con el tratamiento jurídico-penal de las contribuciones imprudentes en la lesión de un bien jurídico penalmente protegido, incluidos la vida e integridad física, cuando la lesión procede de una autopuesta en peligro o de una heteropuesta en peligro consentida. En una reciente sentencia, el BGH ha tomado postura al respecto en línea con la conocida postura de Claus Roxin, según la cual, por regla general, tan solo deberían considerarse impunes las contribuciones en una autopuesta en peligro. Sin embargo, Stratenwerth aboga, al igual que Puppe, por resolver estos supuestos a través de la tradicional figura del consentimiento, sin otorgar relevancia a la distinción fenomenológica entre auto- y heteropuestas en peligro consentidas.

Consented hetero-endangering in negligent wrongdoings.

On the occasion of the Festschrift für Puppe, the author makes his own the thesis of the honoree in relation with the criminal treatment negligent contributions to criminally relevant harms should have, including harms to life or physical integrity, when they come from a selfendangering or from a consented hetero-endangering of the victim. In a recent decision, the stand of BGH on the matter is mostly coincident with that of Roxin, according to which, in general, only self-endangerings should be permitted. However, Stratenwerht, just the same as Puppe, considers applicable the institution of consent, thereby becoming irrelevant the distinction between self-endangering and consented hetero-endangering.
