Imputabilitas y teoría de la imputación

Imputabilitas es capacidad de imputación. Un desarrollo consecuente de esta idea afecta necesariamente a la teoría de la imputación, tanto en lo relativo a la teoría de las normas como al sistema de la teoría del delito. Pero una revisión en ese sentido no sólo requiere el examen del concepto, sino de distintas cuestiones: la denominada “imputabilidad disminuida” o la posible “presunción” de imputabilidad del sujeto. En todo caso, la cuestión a plantear es si los sujetos inimputables (sin imputabilitas) pueden ser considerados, en un principio, sujetos del derecho penal, pues difícilmente puede mantenerse que existen expectativas de cumplimiento de las normas respecto a ellos, que sólo son sujetos de medidas. La conclusión es negativa: el inimputable no puede ser sujeto del deber cuya infracción sanciona el derecho penal y constituye un caso (no el único grupo de casos) de inevitabilidad individual. No es posible el injusto penal de un inimputable; y, por tanto, el análisis sobre la imputación penal de una conducta debe iniciarse con el examen de la imputabilidad penal de su autor.

Imputabilitas and Theory of Imputation

Imputabilitas is capacity to be imputable (of criminal responsibility). A logical development of this idea, necessarily affect the theory of imputation, both in terms of the theory of the rules of law and the system of the theory of crime. But a review in this regard requires not only the analysis of the concept, but the consideration of several issues called «diminished accountability» or possible «presumption» of accountability of the subject. In any case, the question to ask is whether the individuals without imputabilitas can be considered, in principle, subject of criminal law, it can hardly be maintained that there are expectations of compliance with respect to them, which are only subject to measures. The conclusion is negative: the inimputabilis subject can´t be subject of duty, whose offense punishes the criminal law and constitute a case (not the only group of cases) of individual inevitability. There is no possible the criminal injustice of an unaccountable subject (inimputabilis); and therefore, the analysis of the criminal imputation of the behavior should begin with the examination of the criminal responsibility of the author.
