¿Incumbencias en Derecho Penal?.- Depende

El concepto de incumbencia («Obliegenheit») se emplea en Derecho penal con diversas finalidades. El autor responde a la visión crítica expuesta por Juan Pablo Montiel en su reciente artículo al respecto (publicado en InDret Penal 4/2014). Concretamente afronta tres grupos de críticas: su origen iusprivatista; el uso inflacionario de la expresión y concepto; y la indefinición y manipulabilidad por parte de la doctrina penal que se ha referido a las incumbencias. La propuesta del autor consiste en reducir el uso y concepto al ámbito de la imputación extraordinaria, y no a otros que pertenecen al ámbito de las reglas de conducta, y no de imputación.

Concerns in Criminal Law?.- It depends!

The concept of concern («Obliegenheit») is used in criminal law with various functions. The author answers the critical view expounded by Juan Pablo Montiel in his recent article about it (published in InDret Penal 4/2014). Specifically reviews three groups of critics: his private law origin; the inflationary
use of the term and concept; and the uncertainty and manipulability by the criminal doctrine has referred to the concerns. The author’s proposal is to reduce the use and concept to the realm of the strict liability, and not others that fall within the scope of the rules of conduct, and no rules of allocation.
