Las investigaciones internas parecen abrirse camino poco a poco en el sector empresarial español (al menos, en las grandes y medianas empresas), lo que puede estar modificando la tradicional visión que se tenía de la instrucción penal. No existe ninguna previsión legal que las contemple en nuestro ordenamiento, pero su anclaje normativo se infiere y deduce de las previsiones que el Código Penal contiene en materia de responsabilidad penal de las personas jurídicas. Tampoco existe ningún pronunciamiento directo sobre ellas por parte del Tribunal Supremo, si bien en diferentes sentencias ha regulado, indirectamente, determinadas cuestiones relativas a su desarrollo y eficacia en el proceso penal. Por otro lado, de atenderse por nuestros tribunales las resoluciones dictadas por el Bundesverfassungsgericht a propósito del caso Dieselgate, las investigaciones internas podrían verse seriamente restringidas. Nos encontraríamos, pues, ante zanahorias legislativas y palos jurisprudenciales.

Internal Investigations: Regulatory Carrots and Jurisprudential Sticks?

Internal investigations seem to be gradually making their way into Spanish business sector (at least in large and medium-sized enterprises), which may be modifying the traditional view of the criminal investigation. There is no statutory provision that foresees them in our legal system but their normative anchorage can be deduced from several Spanish Criminal Code provisions on corporate criminal liability. Additionally, nor is there any direct decision issued by the Spanish Supreme Court that regulates internal investigations, although it has indirectly delimited some matters regarding their development and effectiveness within the criminal process in different judgments. On the other hand, internal investigations could be seriously restricted if our courts considered the resolutions issued by the German Constitutional Court (Bundesverfassungsgericht) concerning the Dieselgate case. We would therefore be dealing with ‘regulatory carrots’ and ‘jurisprudential sticks’.
