La aritmética electoral tomada en serio: El uso de la estadística en la jurisprudencia del Tribunal Constitucional
Comentario a la STC 105/2012, Sala Primera, de 11 de mayo

Existe una discusión académica sobre la pertinencia de la utilización, a la hora de resolver problemas jurídicos, de las enseñanzas de otras ciencias auxiliares, como pueden ser la economía, la psicología, la estadística, etc. Mediante el análisis de la STC 105/2012 pretendemos justificar como, por ejemplo, en materias como el derecho electoral es ya imprescindible acudir a la estadística en los “casos difíciles”, si se quiere ofrecer una respuesta judicial rigurosa. Partiendo de esas premisas, se realiza una aproximación estadística al problema resuelto, con resoluciones contradictorias, por la Junta Electoral Central, el Tribunal Superior de Justicia de Asturias y el Tribunal Constitucional español.

The electoral arithmetic taken seriously: the use of statistics in the case-law of the Spanish Constitutional Court. Commentary on the Judgment no 105/2012 of the Spanish Constitutional Court

There is a scholarship discussion about the use of the insights of auxiliary sciences such as economics, psychology, statistics, etc, for solving legal issues. By analyzing the Spanish Constitutional Court Judgment 105/2012, we argue that, for instance, in areas such as electoral law, it ́s already indispensable the use of statistics for deciding “hard cases”, if the judges want to offer an accurate decision. Based on these assumptions, in this article we propose a statistical approach to the problem discussed, that was solved in contradictory ways by the Central Electoral Commission, the High Court of Asturias and the Spanish Constitutional Court.
