Hereditary Collation and the Valuation of Donated Property: Distributive Function, Valuation Technique and Coherence of the Succession System

This paper critically examines the function of hereditary collation in light of a problem that directly affects its distributive effectiveness: the valuation of donated assets. The analysis shows that collation operates as a mechanism for the internal ordering of the partition and that its outcome depends decisively on the temporal criterion used to value the gift. The paper considers the evolution of Article 1045 of the Spanish Civil Code, the allocation of patrimonial risk, the alienation and transformation of donated assets, shares and interests in family businesses, and
monetary gifts intended to finance the acquisition of real estate. Drawing on a comparison with Catalan civil law, it argues that valuation at the time of death displays considerable systematic coherence but may also give rise to difficulties when increases or decreases in value result from circumstances arising after the donation. As an alternative, the paper proposes exploring a system of objective updating of the original value up to the opening of the succession, capable of reconciling the patrimonial history of the gift with the distributive purpose of collation. This argument presupposes the existence of a forced heirship system and does not seek to address its general justification, although it does point out that the equalizing function of collation acquires its full meaning only within such a framework.
