La contribución en la comisión de un crimen por un grupo de personas en la jurisprudencia de la Corte Penal Internacional

El modo de responsabilidad penal previsto en el artículo 25(3)(d) del Estatuto de Roma, en el que se criminaliza la contribución en la comisión de un crimen por un grupo de personas que actúa con una finalidad común, ha ganado importante interés en la jurisprudencia de la Corte Penal Internacional y en la literatura especializada. Todo indica que este interés se enfatizará en el futuro. Por ello es útil abordar los principales problemas de interpretación que han surgido en su aplicación jurisprudencial. Se comentan por lo tanto la diferenciación entre la contribución en el crimen cometido por un grupo y la coautoría, el “grado” y la “naturaleza” de la contribución (incluyendo la distinción conceptual entre las contribuciones “insignificantes” y las contribuciones “neutrales”). También se discute si el modo de responsabilidad del artículo 25(3)(d) solo es aplicable a quienes son ajenos al grupo o bien, además, también puede aplicarse a los miembros del grupo que comete el crimen.

The contribution to the commission of a crime by a group of persons in the jurisprudence of the International Criminal Court

The mode of liability provided for in Article 25(3)(d) of the Rome Statute, known as the contribution to the commission of a crime by a group of persons acting with a common purpose, has been the subject of increased interest in the jurisprudence of the International Criminal Court and in academia. It is apparent that such interest will grow even more in the future. Therefore it is useful to address the most prominent problems that have arisen in the judicial interpretation thereof. Accordingly, this article addresses the differentiation between the group of persons acting with a common purpose and co-perpetration and also discusses the “degree” and “nature” of the required contribution (including the conceptual difference between “insignificant” and “neutral” contributions). Moreover, it addresses the question on whether this mode of liability is only applicable to those who are not members of the group or whether it may also be applied to members.
