La doctrina del consumo compartido ha sido utilizada por el Tribunal Supremo español para delimitar el alcance del delito de tráfico de drogas. Según esta doctrina, los casos en los que alguien entrega (o pretende entregar) droga a otra persona para compartir el consumo pueden considerarse atípicos. A estos efectos, el Tribunal Supremo establece una serie de requisitos relacionados con la condición de adictos de los consumidores, el lugar en el que se consume la droga, la cantidad de droga consumida, el número de personas implicadas o la forma en la que se produce el consumo. El automatismo y la disparidad con que suelen aplicarse estos requisitos ponen de manifiesto, sin embargo, cierta confusión en cuanto al fundamento y significado de la doctrina del consumo compartido. El propósito de este trabajo es criticar la interpretación que el Tribunal Supremo ha venido haciendo de esta doctrina y proponer una interpretación alternativa.

The doctrine of shared consumption in the drug trafficking offence (Critical analysis of the Case Law of the Spanish Supreme Court)

The Spanish Supreme Court has used the doctrine of shared consumption to restrict the legal scope of the drug trafficking offence. According to this doctrine, those situations where someone delivers (or intends to deliver) drugs to another person in order to share the consumption might fall outside the legal scope of this offence. In this regard, the Supreme Court has established certain requirements related to whether the consumers are drug addicts or not, the number of consumers, the place where the drug is consumed, the amount of drug consumed, and the way in which it is consumed. The automatic and disparate application of such requirements by the Supreme Court reveals, however, some confusion about the legal basis and meaning of the doctrine of shared consumption. The aim of this contribution is to criticize the Supreme Court´s interpretation of the doctrine of shared consumption and to provide an alternative interpretation.
