La excepcionalidad de la custodia compartida impuesta (art. 92.8 CC)
A propósito de la Sentencia del Tribunal Supremo de 1 de octubre de 2010

El art. 92.8 CC, en su redacción de 2005, instaura la posibilidad de que, excepcionalmente, el juez, a instancia de una sola de las partes, acuerde un régimen de guarda y custodia compartida. El requisito para la adopción de esta medida es que sólo de esta forma se proteja el interés del menor. La STS de 10 de octubre de 2010 establece que el principio que los tribunales deben seguir para acordar las medidas de guarda y custodia es sopesar el interés del menor en cada caso y fundamentar en la sentencia la decisión de acordar una u otra medida y no el tenor literal del art. 98.2 CC.

Shared custody as an exceptional measure. Comments to the Supreme Court Decision (October 1st, 2010)

Art. 92.8 of the Spanish civil Code, as amended by the 2005 reform, establishes the exceptional possibility that the judge, at the request of only one of the parties, agrees to grant shared custody. The requirement for the adoption of this measure is that this is the only way of protecting the best interests of the child. Recently, a Supreme Court Decision has interpreted that Courts, when deciding custody cases, must follow the best interests of the child principle, and justify the decision on those grounds, rather than follow the exact wording of art. 92.8.
