La importancia del trámite de conclusiones y la conveniencia de su práctica en el juicio verbal
Defensa de la utilidad de un trámite procesal

Las conclusiones son un trámite esencial para el proceso. Son la oportunidad de los litigantes para valorar el resultado de la prueba y para ilustrar al juez acerca de la misma, indicándole cómo y por qué ha servido ésta para reforzar sus posiciones. El trámite, sin embargo, está amenazado por multitud de tentaciones a las que la práctica forense no es ajena, sobre todo en la medida en que las partes pueden tratar de valerse del mismo para intentar dar la vuelta a la prueba en lugar de comentar cuál ha sido su resultado. Asimismo, existe un grave problema de inseguridad jurídica respecto a su práctica en el juicio verbal. La Ley procesal no es lo bastante clara al respecto y, por ello, los justiciables se encuentran a menudo ante la duda de cómo se va a desarrollar su pleito. El trabajo trata de exponer cómo deben ser (y cómo no deben ser) las conclusiones para servir lo mejor posible a la finalidad con que están concebidas y aboga, abiertamente, por su necesaria práctica -con la correspondiente aclaración legislativa- en el juicio verbal.

The importance of the report of findings and the appropriateness of their practice in the oral declarative judgment

The report of findings is an essential item for the process. It is the opportunity, for the parties, to evaluate the pieces of evidence and, also, to illustrate the judge about them, indicating to him how and why these proofs have served to endorse their positions. However, this report is threatened by many temptations, as the forensic practice reveals: especially when the parties try to reinterpret the result of the proof instead of commenting their authentic result. In addition to this, there is a serious problem of legal uncertainty regarding its practice in oral declaratory judgment. The procedural law is not clear enough about it and, for this reason, citizens cannot know how their trial could be. This paper tries to explain how the report of findings has to be (and how it should not to be), in order to fulfill its natural purpose and, on the other hand, asks for its mandatory practice in the oral declaratory judgment, by appropriate legislative clarification.
