Existe abundante literatura sobre tribunales en el ámbito de la investigación criminológica y, aunque la mayoría procede del ámbito anglosajón, en España hay un cuerpo de investigación limitado, pero interesante sobre el funcionamiento de los tribunales españoles que permite reflexionar sobre lo que implica realizar investigación en la administración española de justicia y cuáles son las estrategias más adecuadas para llevar a cabo una investigación exitosa en este campo. Este es el objetivo de este trabajo, en el que se reflexionará sobre la oportunidad de realizar investigación sobre tribunales, las dificultades de acceso a la información y los intereses enfrentados que se pueden poner de manifiesto en el desarrollo de la investigación; así como los diferentes dilemas éticos a los que un investigador puede enfrentarse cuando realiza investigación criminológica en los tribunales penales. De igual modo, se explorarán todas las posibilidades que existen para realizar investigación cuantitativa en el ámbito de los tribunales: la observación directa, la revisión de expedientes judiciales, la
revisión de sentencias, las encuestas de opinión a usuarios y a jueces.

Criminological research on courts

There is extensive literature on courts in criminological research and, although most of it comes from the Anglo-Saxon field, there is a solid body of research on the functioning of Spanish courts. This type of study has provided enough information to think about how the process of investigation in courts and its practical implications in the Spanish administration of justice are; as well as the most appropriate strategies to carry out successful research in this field. This is the objective of this work in which it will be reflected on the opportunity to research in courts, the difficulties of access to information and the conflicting interests that may be revealed in the development of the investigation; as well as the different ethical dilemmas that an investigator may face when conducting criminological research in criminal courts. In the same way, all the possibilities that exist to carry out quantitative research in the field of the courts will be explored: direct observation, review of judicial files, review of sentences, and opinion surveys.
