La figura de la puesta en peligro de otro con su consentimiento (heteropuesta en peligro consentida), que yo mismo comencé a poner en circulación en 1973, se ha convertido en una de las cuestiones más discutidas de la Parte General del Derecho Penal en Alemania. De ella se vienen ocupando intensamente asimismo la jurisprudencia y la doctrina españolas. Cancio Meliá y Luzón Peña han participado además en esta discusión con sendas publicaciones en lengua alemana. Espero, por tanto, que la confrontación con el más reciente estado de esta cuestión en Alemania pueda tener también interés para un auditorio español.

The controversy over the “consented hetero-endangerment” (endangering of another with his consent). On the extent of the principle of victim self-liability in Criminal Law.

The legal construct of endangering another with his consent (“consented hetero-endangerment”), that I first proposed in 1973, has become one of the most discussed topics of the Criminal Law theory in Germany. The Spanish case law and legal scholarship have dealt intensely with this issue. Cancio Meliá as well as Luzón Peña have also taken part in this discussion with contributions in German language. Therefore I hope, that the confrontation with the latest developments of the question in Germany may also interest a Spanish audience.
