Las elecciones del 9 de marzo de 2008 y la igualdad de voto

El sistema electoral del Congreso de los Diputados ha sido frecuentemente criticado por la escasa proporcionalidad que genera el mecanismo de conversión de los votos en escaños. Esta diferencia entre el apoyo electoral que recibe un partido y la representación parlamentaria que obtiene se ha puesto otra vez de manifiesto en las últimas elecciones celebradas el 9 de marzo de 2008. Ello ha desencadenado no pocas críticas, que denuncian la vulneración del derecho al sufragio igual y del derecho a la igualdad en el acceso a funciones y cargos públicos, ambos reconocidos en nuestra Constitución.

Desde el punto de vista constitucional, el principio de igualdad del voto posee un doble significado: el estrictamente formal, que se refiere al derecho de participación política y está relacionado con el método de reparto de escaños entre las circunscripciones (según su población residente o número de electores inscritos); y el significado material, que es exigible sólo en los sistemas electorales de lógica proporcional y está relacionado con el mecanismo de conversión de los votos emitidos en escaños. Nuestro sistema electoral conculca abiertamente ambos aspectos de la igualdad del voto.

El presente trabajo trata de analizar el origen y el alcance de dichas desigualdades de representación, referidas a la convocatoria de marzo de 2008, y propone algunas soluciones para atenuar dichos efectos.

The 9th march 2008 elections and equal vote

Spanish parliament’s electoral system has been frequently criticized for the scarce proportionality resulting from the application of its mechanism for the conversion of votes into seats.

The gap between the electoral support and the parliamentary representation of the parties was once more revealed after the 9-M elections. Recent critics of the voting system cast doubts on its consistency with the constitutional framework in which the parliamentary electoral system is embedded. According to them, the present system infringes the right of equal voting and the right of equal access to public positions.

From a constitutional perspective, the meaning of the right of equal voting is two-fold: formal and substantive. On the one hand, the formal meaning refers to the right of political participation and it is related to the seats apportionment among electoral constituencies according to their population or their number of registered voters. On the other hand, the material meaning is a distinctive feature of the proportional electoral systems and refers to the mechanism for transforming votes into seats. Our electoral system openly disregards both aspects of the right of equal vote.

This paper aims to analyse the origin and the scope of the mentioned inequalities of representation, referred to the 9-M elections, and proposes some solutions oriented to lessen these undesirable effects.
