Liability for Artificial Intelligence and other emerging technologies

El presente artículo constituye un análisis de los aspectos más relevantes del reciente informe publicado por el Grupo de Expertos en Responsabilidad y Nuevas Tecnologías el pasado 21 de noviembre de 2019 titulado “Liability for Artificial Intelligence and other emerging technologies”, del que se destacan las cuestiones de mayor relevancia: causalidad, las propuestas que los expertos formulan respecto de las reglas de responsabilidad  para resolver los retos que las nuevas tecnologías plantean para los ordenamientos jurídicos, los potenciales sujetos responsables (en particular, sobre si debería o no darse personalidad a los sistemas dotados de inteligencia artificial) y, finalmente, la operatividad de la excepción en materia de productos defectuosos por riesgos de desarrollo.

Liability for Artificial Intelligence and other emerging technologies

This article is an analysis of the more relevant issues raised by the recently published report made by the Expert Group on Liability and New Technologies at November 21, 2019 named “Liability for Artificial Intelligence and other emerging technologies”: causality, the proposals of the experts in regards to the more optimal liability rules to solve the challenges posed by new technologies, the potential liable subjects (in particular, if machines bestowed with artificial intelligence shall be granted legal personhood) and, finally, how will work the state of the art defense for defective products.
