Orden Europea de Investigación: régimen de sustitución de la medida solicitada

La implementación de la Orden europea de investigación (OEI) representa un importante paso adelante en la construcción de un espacio único de libertad, seguridad y justicia al simplificar la obtención transnacional de pruebas en materia penal. En este artículo se analiza una de las previsiones específicas de la Directiva 2014/41/UE -el recurso por la autoridad de ejecución a una medida distinta de la solicitada por la autoridad de emisión- y su encaje en la Ley española de reconocimiento mutuo de resoluciones penales en la UE. Se trata de una importante disposición prevista para tres supuestos distintos: cuando la medida solicitada en la OEI no exista en el derecho nacional del Estado de ejecución o no esté prevista para un caso similar, o cuando pueda adoptarse otra medida diversa e igualmente eficaz pero menos coercitiva. El uso frecuente de esta previsión pone de relieve los retos que plantean las diferencias entre los sistemas jurídicos de los Estados Miembros; en particular los diferentes requisitos jurídicos de las medidas de investigación.

European Investigation Order: grounds for applying an alternative investigative measure other than that provided in the EIO

The implementation of the European Investigation Order (EIO) represents a major step forward in the building up of a single Area of Freedom Security and Justice by simplifying the transnational gathering of evidence in criminal matters. In this paper the specific aspect of the Directive 2014/41/EU regarding the European Investigation Order will be analysed – recourse by executing authority to an alternative investigative measure than the one requested by the issuing authority – and how it has been incorporated in the Spanish Act on mutual recognition of judicial decisions in criminal matters in the European Union. This is an important provision applicable in three cases: where the investigative measure indicated in the EIO does not exist under the law of the executing State or it would not be available in a similar domestic case or where there is other investigative measure which would have the same result as the investigative measure requested. The frequent use of this provision highlights the challenges created by the different legal systems in the Member States; particularly the different legal prerequisites for investigative measures.
