Las teorías que consideran la pena como retribución tienen como punto de referencia a Kant, aunque también existe una discusión reciente sobre si la retribución era en realidad el fundamento de la pena en su teoría de derecho. Por esa razón, el desarrollo de cualquier teoría retributiva ha de considerar a Kant, porque su teoría de la retribución ha definido el marco de la discusión sobre el concepto, y atender a textos de la filosofía moral o de la razón pura mostrar cuál es el marco de discusión sobre la retribución de la dogmática penal. En ese marco se intenta explicar una teoría de la retribución conforme a la ley natural, como forma de concretar la necesidad moral de la pena y su vinculación a la razón práctica. Sin embargo, no todos los aspectos de la pena con la que se castiga un hecho concreto son abarcados por esta necesidad moral. El objetivo último es, por tanto, la definición de estos límites y de la compatibilidad de la teoría de la retribución con una justa individualización de la pena sobre la base de la culpabilidad -con una adecuada comprensión de la idea de arrepentimiento- y con la posibilidad de suavizar o incluso de suspender la ejecución de penas.

Pœna forensis and Retribution. Proposal on the Restoration of a Theory

Theories that regard the punishment as retribution have as a reference point to Kant, although there is also a recent discussion about whether retribution was certainly the foundation of punishment in his theory of law. For this reason, the development of any retribution theory should consider Kant, because his theory of retribution has defined the framework of the discussion on the concept, and to attend to texts of moral philosophy (practical reason) or pure reason to show what is the framework of discussion on retribution in the criminal law doctrine. In this context, an attempt is made to explain a theory of retribution under natural law, as a way of realizing the moral necessity of the punishment and its link to practical reason. However, not all aspects of the punishment for a crime are covered by this moral necessity. The last objective is therefore the definition of these limits and the compatibility of the theory of retribution with a just sentencing on the basis of culpability – with an adequate understanding of the idea of repentance – and with the possibility of softening or even suspending the execution of penalties
