El principio de disminución del riesgo determina la atipicidad de la acción que según un juicio ex ante reduce un riesgo ya existente, aun cuando la variación experimentada en este riesgo conduzca finalmente a la producción de un resultado típico. Mas, dado que, ex post, un resultado producido es más grave que la mera hipótesis de que él se produjera en la configuración originaria del riesgo, la atipicidad por disminución del riesgo tiene que conducir a que la medida de todo ilícito, cuando los riesgos son reprobados, también debiera determinarse según la intensidad del riesgo creado al momento de la acción. Una tentativa que crea un alto riesgo debe ser más grave que una que genere un riesgo menor aun cuando ésta conduzca a la consumación, y aquélla, no. Risk reduction principle vs. importance of results in criminal law theory

It follows from the principle of diminution of risk that an agent is exonerated from criminal responsibility for an action that, if considered ex ante, reduces an existing prohibited risk. This applies even if it is this action that ultimately leads to the wrongful result. However, ex post the actual occurrence of the wrongful result is more serious than the mere possibility of the wrongful result caused by the prohibited risk. Accepting this implication of the principle of diminution of risk entails that the seriousness of any wrong must also be determined by the intensity of the risk created by the initial action. A criminal attempt that creates a greater risk must therefore be more severely punished than one which creates a lesser risk, even if only the latter results in that risk causing the wrongful result. It is self-contradictory to see the production of the result as an element of the seriousness of the offence (ex post) and to also see the diminution of a prohibited risk as a ground for exoneration of criminal responsibility (ex ante).
