Sistema de clasificación penitenciaria y el «periodo de seguridad» del art. 36.2 CP

En el cumplimiento de pena privativa de libertad rige actualmente en España un sistema progresivo de individualización científica. No obstante, se ha ido incorporando en los últimos años, mediante varias reformas del CP y de la legislación penitenciaria, un excepcional sistema progresivo objetivo. En lo relativo al sistema de clasificación penitenciara ello se plasma en el establecimiento de un «periodo de seguridad» (cuando la pena de prisión impuesta sea superior a 5 años se requiere el cumplimiento de la mitad de la misma para acceder al tercer grado con independencia de la evolución del interno). En el texto se analiza el modo en que esta medida afecta al principio de resocialización así como otros aspectos problemáticos: el cómputo de la pena que se va a utilizar como referencia para medir la duración del periodo de seguridad o su alcance a enfermos graves con padecimientos incurables.

Penitentiary classification system and the «security period» (art. 36.2 CP)

When it comes to the serving of a prison sentence, a progressive system of scientific individualization is currently in force in Spain. However, in the last few years some extraordinary measures have been introduced by several reforms of the Spanish Criminal Code and penitentiary laws, which establish an alternative, objective and progressive system. Concerning the penitentiary classification system, this changes take the form of the so-called «security period» (when the prison sentence is longer than 5 years it requires the serving of at least half of it in order to be eligible for the penitentiary third degree, regardless of the situation of the criminal). In the following article the author analyzes the way in which this measure affects the constitutional principle of resocialization, as well as many other problematic and related issues, such as the amount of punishment that is going to be used in order to calculate the length of the «security period» or its adequacy when dealing with extremely ill people which suffer untreatable pains.
