Sobre el objeto de tutela en los delitos patrimoniales de apoderamiento (hurto, robo, robo y hurto de uso de vehículos de motor)

Pese a que la conducta externa de los delitos de apoderamiento es idéntica, la doctrina y la jurisprudencia han concebido de forma diferente el bien jurídico protegido en el hurto y en el robo común (por un lado) y en el robo y hurto de uso de vehículos (por otro lado). También se han presentado teorías muy diversas en torno al lugar que ocupa en el objeto de tutela el derecho de propiedad y la posesión. En la presente contribución se ensayan dos tesis que unifican la interpretación del objeto formal de estas figuras delictivas en torno al derecho de propiedad y ubican la posesión en el desvalor de acción. Se fundamenta esta posición recurriendo a la respectiva naturaleza de infracciones de peligro concreto y de peligro abstracto, que se proyecta en su consideración como delitos de resultado o de mera actividad. De esta nueva interpretación se extraen consecuencias prácticas en relación con el mínimo de ofensividad de la relevancia penal de ciertos comportamientos humanos, los requisitos de la consumación, el entendimiento del ánimo de lucro o la diferenciación entre autor y partícipe.

On the Affected Interest in Crimes Based on the Unlawful Seizing of Goods

Crimes based on the unlawful seizing of goods are characterized by an identical external behavior. However, literature and case law claim there is a difference when it comes to what the legally protected good is in the prohibition of theft (in Spanish Criminal Law: “hurto” and “robo con fuerza”) and in the prohibition of the so-called “unauthorized use of vehicle” (“hurto de uso” and “robo de uso”). Moreover, there are several theories at hand to explain the role of the right of property and of the right of possession in that regard. This paper presents two arguments which unify the formal object of both crimes in the right of property, and locate the right of possession as the key to determining the wrongdoing of the act. This position is grounded on the different nature of crimes based on a concrete endangerment of the legally protected good and those based on its abstract endangerment, which in turn is reflected in their consideration as result-oriented or act-oriented crimes, respectively. This new interpretation entails practical consequences regarding the damage threshold required of certain behaviors in order to be criminally relevant, the requirements for the perfection of the crime, the proper understanding of the purpose of self-enrichment, and the distinction between principal and accomplice.
