En el presente trabajo se aborda el análisis del nivel de cumplimiento por parte del Estado español de los requerimientos internacionales derivados de la aproximación victimocéntrica a la trata de seres humanos. La aprobación del Convenio de Varsovia y la de la Directiva 2011/36/UE han determinado la hegemonía a nivel internacional del abordaje de este fenómeno criminal desde la perspectiva de los derechos humanos. Tras dos años de la introducción del delito de trata en nuestro ordenamiento jurídico y del emprendimiento de acciones instrumentales para luchar contra esta realidad, el objeto de este trabajo consiste en determinar el grado de observancia de las obligaciones internacionales de persecución, prevención y protección de las víctimas, tomando para ello en consideración no solo el derecho vigente en España, sino también las proyectadas reformas tanto en el ámbito del derecho penal sustantivo como del derecho procesal penal.

Victims of human trafficking: their protection according to recent reforms projected in substantive and procedural criminal law

In this paper the level of compliance of the Spanish State of international requirements derived from the victim centric approach to the trafficking of human beings is analyzed. The approval of the Warsaw Convention and the Directive 2011/36/EU determined the hegemony of an international criminal approach to this phenomenon from the perspective of human rights. After two years of the introduction of the crime of human trafficking in our legal system and the implementation of instrumental actions to combat this phenomenon, the aim of this work is to determine the degree of fulfillment of the international obligations of prosecution, prevention and protection of victims, taking into account not only the law in force, but also the projected reforms both in the fields of substantive and procedural criminal law.
