Criterios procedentes de algunos textos europeos de soft law y del Derecho estadounidense que podrían servir para su reforma e interpretación

La regulación vigente de la prescripción de las acciones generales de responsabilidad civil extracontractual y por daños derivados del incumplimiento es la original de 1889. Esta normativa no resulta adecuada a las peculiaridades de algunas clases de daños, muy trascendentes en la práctica, y que no existían o que, al menos, eran irrelevantes en el momento de su promulgación. En este trabajo se describen y analizan una serie de modelos en los que se contienen las líneas maestras hacia las que debería dirigirse el Derecho civil común en el momento en que decida acometerse su reforma. Igualmente, y hasta que dicha reforma se produzca, la evolución, a lo largo del siglo XX, del modo de intepretar los statutes of limitations del Derecho estadounidense podría aportar alguna orientación interpretativa de interés en relación con las normas estatales todavía en vigor.

Extinctive Prescription Rules Applicable to Remedies for Tort and Damages Derived from a Breach of Contract (Dies a Quo and Duration of the Term): Some Comparative Law Models for Reforming and Interpreting the Current Spanish Law

The current regulation on the statute of limitations for liability for the harm suffered for breach of contract is the originally established by the Spanish civil code of 1889. But this regulation does not seem to be the most adequate when considering the characteristics and nature of some types of damages resulting from breach of contract that did not exist or were irrelevant when the Spanish Civil code was adopted. This paper describes and analyzes the regulatory models that should serve as the inspiration to the Spanish legislator when Spanish Civil law in this matter is subject to reform. Additionally, it further argues that the interpretative evolution of the regulation of the statutes of limitations in the different U.S. jurisdictions could provide useful insight for improving the effectiveness of the Spanish regulation currently in force
